Terms and Conditions
These Terms & Conditions govern the use of the WardWalk platform, website, mobile applications, and related services ("Services") operated by WardWalk for Canadian municipal election campaigns. Please read these terms carefully before accessing or using our services.
1. Acceptance of Terms
By creating an account or using WardWalk, you agree to these legal terms. If you are acting on behalf of a candidate or campaign, you represent that you have the authority to bind that entity to this agreement.
2. Eligibility and Authorized Use
WardWalk is strictly for authorized use in Canadian municipal or local election campaigns. Users must be at least 18 years of age. Use for commercial purposes or unauthorized data collection is strictly prohibited.
3. Account Access and Roles
Campaigns manage team access via unique logins. Account sharing is prohibited to maintain data security. Leadership is responsible for all activity conducted under their campaign profile and for managing volunteer permissions.
4. Use of Voter and Campaign Data
The campaign retains full ownership of data entered into the platform. WardWalk acts as a service provider only and does not sell or share campaign data. Voter lists provided by the campaign must be used in accordance with provincial election authorities.
5. Privacy and Compliance Responsibilities
Campaigns are responsible for their own compliance with the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA). WardWalk provides security features, but the legal duty to protect voter privacy lies with the candidate and their staff.
6. Payments, Licenses and 2026 Campaign Packages
Full platform access for the 2026 cycle is granted through ward-based licenses. All fees are in CAD and are non-refundable once the 7 days after the campaign start date has passed, reflecting the critical peak-usage nature of the platform.
7. Refund Policy
Full refunds are available within 7 days of purchase if you are not satisfied with the platform. After 7 days, refunds or credits may be considered at our discretion and may be prorated based on usage.
8. Service Availability and Changes
We strive for high availability during election windows. We reserve the right to modify features to improve performance or comply with legal changes. Notice will be provided for any significant service interruptions.
9. Disclaimers and Limitation of Liability
WardWalk is provide "as is" without guarantees of election success. We are not liable for campaign decisions made based on system data. Our liability is limited to the amount of the license fee paid by the campaign.
10. Prohibited Uses
Users may not attempt to scrape voter data, re-sell the service, or use the platform for illegal harassment or spam. Violations will result in immediate termination without refund.
11. Termination
We may terminate access for material breaches of this agreement. Campaigns may cancel at any time, but data export must be completed by the campaign manager prior to final account deletion.
12. Governing Law (Ontario, Canada)
This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be settled in the jurisdiction of Ontario.
